Polytunnels, and growers’ battles to use and justify them, have been a constant source of struggle for years, but things have really heated up in the last few weeks with the developments in Herefordshire and their interpretation of the Hall Hunter decision.

In the style of planning officials nationwide, Herefordshire County Council seem to have done their best to make matters as confusing and frustrating as possible for growers.

We are hearing that it could take 18 months to agree on the criteria for legislation; that there is talk of immediate action being taken against growers; there is even the suggestion of retrospective planning enforcement notices. More optimistic voices speak of the possibility that the proposals might be revoked.

The situation is an absolute mess, and councils are clearly unsure how to interpret the Hunter decision. There needs to be clear guidance from government on this, and it needs to come down in favour of responsible businesses, not punishing a whole sector for one or a small number of firms’ poor performance.
