Potato growers purchasing seed from Europe should be fully aware of the onerous clauses and complex procedures which often favour the buyer over the seller within the RUCIP conditions of sale, the NFU says.

These form a specialist standard form contract designed for use by commercial buyers and sellers of seed and ware potatoes. The RUCIP 2006 (the contract) is a hefty document which, including annexes, stretches to 74 pages and many growers will not be familiar or have the time to consider the commercial and practical effect of all the clauses within it.

Following a recent arbitration case the NFU is concerned that growers accepting these terms and conditions have very little recourse if a dispute arises.
