The Fresh Produce Consortium is pressing for more detailed guidance on the Agency Worker Regulations which will come into force in October 2011.

The legislation aims to ensure that agency workers are treated equally after 12 weeks’ continuous employment in relation to permanent employees carrying out the same job.

The trade body is pushing for advice on the responsibilities expected of labour users in relation to agency workers.

In a response to its initial inquiry to the government, the Department of Business, Innovation and Skills, said: “The government is aware from recent press articles and from direct contact with business bodies that there are differing points of view about certain aspects of the regulations which were laid before parliament in January 2010 and are due to come into force in October 2011.

“The government is considering a way forward on this issue amongst many others, and hopes to be in a position to announce its conclusion in the near future. Guidance will be developed as soon as this has taken place.”
