EU garlic import regulations change

An amendment harmonising the administration procedures across the EU for imports of garlic from third countries has been published.

In amending regulation 341/2007 to become EC Regulation 328/2010, the EU aims to ensure fair opportunity to all traders by the category of importers.

The regulation will now include certain exporters of garlic to third countries within the category of traders who may apply for import licences under the tariff quota system.

Traders can be included provided that they have imported into the EU at least 50 tonnes during the last completed import tariff quota period preceding the submission of their application.

The reference quantities of traditional importers are calculated on the basis of the average of the quantities of garlic imported during the previous three calendar years preceding the related import tariff quota period.

The regulation is set to be in force from 1 May 2010 but to allow importers to adapt the new provisions concerning the calculation of the reference period and the submission of proof of actual imports of garlic, it will only apply from 1 February 2011.
