Spanish fruit variety club CVVP has announced that it has won a court case against a Valencian citrus grower for planting a greater number of Nadorcott mandarin-producing trees than those permitted under his license.
Ruling in favour of the variety club, a judge at Valencia’s number one commercial court ordered the grower to pull up and destroy an unspecified quantity of Nadorcott trees, as well as having to pay the organisation over €29,000 in damages and legal costs.
In a statement, CVVP said the ruling amounted to legal confirmation of the group’s stance that planting a greater number of Nadorcott-producing trees than those allowed under the terms of its production license constituted a breach of that contract.
The variety club said that following the ruling it would continue to pursue similar actions against other growers found to be in breach of contract, even in cases where planting had begun prior to the release of the licensing agreement.
